For a health lawyer in private practice, the substance of any discussion of managed care turns on the developments in the health care marketplace. Without a doubt, the industry is rapidly moving from one frame of reference to a radically different one. It is no surprise then, that, in consulting me, my clients want to know what is and what will be, not what should be. They want at least to survive, if not be successful, in the whirlwind of restructuring (...) that offers no clear choices, no clear outcomes, and significant legal liabilities if they do not perform effectively. What I want to address in this article is how the consolidation of medical practices and the integration of delivery structures has outpaced the legal system's ability to regulate or guide the emerging health care market. This gap leaves physicians without proper legal guidance on how to balance their duties to their patients and their contractual obligations to managed care organizations. A brief review of the case law to date highlights some of the legal and ethical issues that arise for physicians who practice in this environment. (shrink)

The topic of temporal meaning in texts has received considerable attention in recent years from scholars in linguistics, logical semantics, cognitive science, and artificial intelligence. Representing Time in Natural Language offers a systematic and detailed account of how we use temporal information contained in a text or in discourse to reason about the flow of time, inferring the order in which events happened when this is not explicitly stated. A new representational system is designed to formalize an appropriately context-dependent notion (...) of situated inference. The Dynamic Aspect Tree, representing temporal dependencies, constitutes a novel and important dynamic temporal logic, one that makes it easy to see "what follows when" from the information given in an ordinary English text. Logically, weighting is transitive, but similarity is not, so clustering cannot be either. Entailments must help a child to review attribute lists more efficiently. Children's understanding of exceptions to generic claims precedes their ability to articulate explanations. So agency, as enabling constraint, may show coherent covariation with attributes, as mere extensional, observable effect of intensional entailments.

In the modular design of generative theory the syntax-semantics interface has accounted all along for meanings at the level of Logical Form. The syntax-pragmatics interface, on the other hand, is the result of what one may call the 'pragmatic turn' in the linguistic theory, where content is partitioned into given and new information. In other words, the structural division of the clause has been subjected to criteria of information, or discourse structure. Both interfaces require a structurally descriptive inventory whose specific (...) shapes can be motivated on theory-internal grounds only. The present collection of original articles develops the concept of these interfaces further. Interoception, the ability to feel the body’s internal sensations, is an essential aspect of emotional experience. There is mounting evidence that interoception is impaired in common mental health disorders and that poor interoceptive awareness is a major contributor to emotional reactivity, calling for clinical interventions to address this deficit. The manuscript presents a comprehensive theoretical review, drawing on multidisciplinary findings to propose a metatheory of reinforcement mechanisms applicable across a wide range of disorders. We present a reconsideration of operant conditioning (...) through the co-emergence model of reinforcement, which is a neurophenomenological account of the interaction between cognition and interoception, and its consequences on behavior. The model suggests that during memory processing, the retrieval of autobiographical memory (including maladaptive cognition) is dependent upon its co-emerging interoceptive cues occurring at the encoding, consolidation and reconsolidation stages. Accordingly, “interoceptive reinforcement” during emotional distress is a common factor to all emotional disorders and a major cause for relapse. We propose that interoceptive desensitization has transdiagnostic benefits, readily achievable through the cultivation of equanimity during mindfulness training and can be integrated in cognitive and behavioral interventions to permit a transdiagnostic applicability. We summarize the contributions of this approach into 10 specific and testable propositions. (shrink)

Philosophers have applied the framework of constitutive grounds to make sense of the disagreement between subjectivism and objectivism. The framework understands the two theories as being involved in a disagreement about the extent to which value is determined by attitudes. Although the framework affords us with some useful observations about how this should be interpreted, the question how value can be determined by attitudes in the first place is left largely unanswered. Here we explore the benefits of a positive interpretation (...) which aims to address this oversight and make the framework more informative. This interpretation, which is inspired by the recent work of Schroeder and Sobel, claims that the relevant sense in which value can be determined by attitudes is discovered by seeing how facts can be endowed with the normative property of being a reason. We argue that this interpretation significantly deepens our understanding of the disagreement between subjectivism and objectivism. (shrink)

Meaning is made out of the world by our actions in certain situations. But there are so many different things we can do, few of which actually create meaning. Not only do we utter linguistic expressions, but we move, gesture, point; we plan our actions to satisfy particular goals, we form beliefs, presumptions and prejudices, as well as ascribe intentions to other actors. In this paper three ways of acting are singled out for their function in making meaning out of (...) the world: demonstrations, indications and experiments. The paper develops some Wittgensteinean themes, such as the priority of demonstration, the nature of pictorial representations and the relation between interpretation and calculation, in the terms and concepts of Situation Theory. It attempts to weave some important elements of Wittgenstein’s thought in with an account of situated meaning and interpretation, without embarking on any archeological adventure. The paper is intended as a contribution to the philosophical foundations of Situation Theory and a critical commentary to some of its published accounts. Although Situation Theory has been developed with a sharp awareness of its antecedents in Bertrand Russell’s work, as well as its immediate heritage of central aspects of David Kaplan’s account of demonstrative reference, to my knowledge its Wittgensteinean roots have not been traced. The account of demonstrations, indications and experiments advocated here shows not only that important philosophical concerns of Situation Theory have their precursors in Wittgenstein’s work, but also that some of his insights could profitably be absorbed into its new foundations for a theory of meaning. Validity of dynamic temporal reasoning is semantically characterized for English and Dutch aspectual adverbs in Discourse Representation Theory. This dynamic perspective determines how the content needs to be revised and what information is preserved across updates, when the order of premises is considered relevant. Resetting contextual parameters relies on modelling the basic aspectual polarity transitions and temporal reasoning extensionally. For intensional aspectual adverbials the speaker’s attitudes regarding past alternatives to and possible continuations of the current state come into play. Modelling human reasoning characterizes the fundamental human cognitive capacity to describe our past experience and use it to form expectations as well as plan and direct our future actions. Natural language semantics analyzes dynamic forms of reasoning in which the real-time order determines the temporal relations between the described events, when reported with telic simple past-tense clauses. It provides models of human reasoning that could supplement ACT-R models.

In designing stratified models of human language, understanding notions of logical consequence and validity of inference require separating the aspects of meaning that vary between models from logical constants. Modelling meaning requires choices regarding the primitives, where the Fregean program is still offering us the fundamental insights on the role of truth, judgement, and grasping or sharing of thoughts.

Semantic realism fits Millikan's account of kind terms in its focus on information-theoretic abilities and strategic ways of gathering information in human communication. Instead of the traditional logical necessity, we should interpret rigid designation in a dynamic semantics as a legislative act to constrain possible ways in which our belief may change.

This Handbook documents the main trends in current research between logic and language, including its broader influence in computer science, linguistic theory and cognitive science. The history of the combined study of Logic and Linguistics goes back a long way, at least to the work of the scholastic philosophers in the Middle Ages. At the beginning of this century, the subject was revitalized through the pioneering efforts of Gottlob Frege, Bertrand Russell, and Polish philosophical logicians such as Kazimierz Ajdukiewicz. Around (...) 1970, the landmark achievements of Richard Montague established a junction between state-of-the-art mathematical logic and generative linguistic theory. Over the subsequent decades, this enterprise of Montague Grammar has flourished and diversified into a number of research programs with empirical and theoretical substance. This appears to be the first Handbook to bring logic-language interface to the fore. Both aspects of the interaction between logic and language are demonstrated in the book i.e. firstly, how logical systems are designed and modified in response to linguistic needs and secondly, how mathematical theory arises in this process and how it affects subsequent linguistic theory. The Handbook presents concise, impartial accounts of the topics covered. Where possible, an author and a commentator have cooperated to ensure the proper breadth and technical content of the papers. Language is more than a source of information for accessing higher-order conceptual knowledge. Indeed, language may determine how people perceive and interpret visual stimuli. Visual processing in linguistic contexts, for instance, mirrors language processing and happens incrementally, rather than through variously-oriented fixations over a particular scene. The consequences of this atypical visual processing are yet to be determined. Here, we investigated the integration of visual and linguistic input during a reasoning task. Participants listened to sentences containing conjunctions or disjunctions and (...) looked at visual scenes containing two pictures that either matched or mismatched the nouns. Degree of match between nouns and pictures and between their expected and actual spatial positions affected fixations as well as judgments. We conclude that language induces incremental processing of visual scenes, which in turn becomes susceptible to reasoning errors during the language-meaning verification process. (shrink)

Background: Post-traumatic stress disorder is a prevalent, debilitating, and costly psychiatric disorder. Evidenced-based psychotherapies, including Cognitive Processing Therapy, are effective in treating PTSD, although a fair proportion of individuals show limited benefit from such treatments. CPT requires cognitive demands such as encoding, recalling, and implementing new information, resulting in behavioral change that may improve PTSD symptoms. Individuals with PTSD show worse cognitive functioning than those without PTSD, particularly in acquisition of verbal memory. Therefore, memory dysfunction may limit treatment gains in (...) CPT in some individuals with PTSD. Methods and Analysis: Here, we present a protocol describing the Cognition and PsychoTherapy in PTSD study, a prospective, observational study examining how cognitive functioning affects treatment response in CPT for PTSD. The study aims to recruit 105 outpatient veterans with PTSD between the ages of 18 and 70 years. Prior to beginning 12 sessions of CPT, Veteran participants will have standardized assessments of mood and functioning and complete a comprehensive neurocognitive battery assessing episodic learning, attention and speed of processing, language ability, executive control, and emotional functioning. This study aims to fill gaps in the current literature by: examining the specificity of memory effects on treatment response; exploring how baseline cognitive functioning impacts functional outcomes; and examining potential mechanisms, such as memory for treatment content, that might explain the effects of baseline memory functioning on PTSD symptom trajectory. Discussion: If successful, this research could identify clinically relevant neurocognitive mechanisms that may impact PTSD psychotherapy and guide the development of individualized treatments for PTSD. These notes of G. E. Moore's lectures for the three terms of 1934-1935 were compiled by Alice Ambrose, then Student of Newnham College, and Margaret Macdonald, then Fellow of Girton College. The lectures cover a wealth of interrelated topics, and provide instances of the analyses which made Moore «the father of the analytic school.» Since his analyses of such concepts as material objects, sense data, and truth rest on the ordinary use of expressions for these concepts, «ordinary language» philosophers (...) found in him their champion. This essay addresses the question whether artificial speakers can perform speech acts in the technical sense of that term common in the philosophy of language. We here argue that under certain conditions artificial speakers can perform speech acts so understood. After explaining some of the issues at stake in these questions, we elucidate a relatively uncontroversial way in which machines can communicate, namely through what we call verbal signaling. But verbal signaling is not sufficient for the performance of a speech (...) act. To explain the difference, we elucidate the notion of a speech act developed by Austin in the mid-twentieth century and then discuss Strawson’s influential proposal for how that notion may be related to Grice’s conception of speaker meaning. We then refine Strawson’s synthesis in light of Armstrong’s reconceptualization of speaker meaning in terms of objectives rather than intentions. We next extend this conception of speech acts to the cases of recorded, proxy, and conditional speech acts. On this basis, we propose that a characteristic role for artificial speakers is as proxies in the performance of speech acts on behalf of their human creators. We also consider two objections to our position, and compare our approach with others: while other authors appeal to notions such as “quasi-assertion,” we offer a sharp characterization of what artificial speakers can do that does not impute intentions or similarly controversial powers to them. We conclude by raising doubts that our strategy can be applied to speech acts generally. (shrink)
